The Ministry of Labour’s Inspector-General and spokesperson Mr. Ananchai Uthaipatanacheep spoke about the Thai Rath newspaper published on 30 January 2017, referring to the column which wrote about an employer (“Migrant Worker Employer”). It asked relevant parties to consider limitations of migrant workers’ pink cards as the address of workplace did not match the real work location address.
The Department of Employment provided information on the Working of Alien Act B.E. 2551, which allows foreign workers to work only in permitted work locations. In the process, migrant workers must request work permits which will then be considered by the registrar who will evaluate the necessity for employment. Instances for migrant worker employment includes in construction, logistics or work of a repetitive nature. The registrar will also look at the province and location of employment, or in some cases several locations such as for profession in logistics and transportation. An application must be filled out, attached with documents and evidence of payment comprising a work application form of 100 Baht, a work permit costing 900 Baht per year, which totals 1,000 Baht per person.
Employers facing issues regarding the location of workplace for foreign workers can submit a request to the registrar for further consideration. Employer can contact the Bangkok Employment Office 1-10 or provincial offices, which will issue a certification of the permit as evidence. “Labour Minister General Sirichai Distakul’s policies on government officials’ work is clear. We must work transparently and quickly, and our actions must be assessable. Any circumstances of corruption will result in the highest penalty,” said Mr. Ananchai.
