Mrs. Wang Ju-shuan, Chairperson of Council of Labour Affairs or CLA, revealed in the near future, over-stayed foreign workers will be protected under the Protection For Workers Incurring Occupational Accident Act.
Foreign workers, who overstay or runaway, and thus become illegal workers in Taiwan, will be eligible to apply for allowance in case of partial or permanent disability caused by working. Their family members can apply for compensation up to the amount of 45 months of their family member’s basic wage if they die in an accident. This is part of a set of revisions to the Act, proposed by the CLA and now being reviewed by the Legislative Yuan.
Furthermore, the CLA Chairperson stressed that foreign workers who become illegal workers after sneaking into Taiwan or entering the island using tourist visa will not be protected by the aforementioned act. Under the amendment, employers will be required to bear the burden of proof regarding any occupational accident; and if employers fail to offer evidence to prove that they have done their best to prevent the accidents, they will be required to pay compensation to the victim.
