Chen Chang-wen, president of National Red Cross Society of Taiwan agreed with Council of Labor Affairs (CLA) to revise the bill to extend the maximum length of contract for foreign labours working in Taiwan from the current nine years to 12 years to meet demand according to the proposal of Kuomintang ruling amendment of the act that would extend the duration of foreign workers’ stay to 12 years. The extension would have no adverse impact on job -opportunities for Taiwanese. Hopefully, it could maintain a number of foreign workers to be allowed working in the country in order to reduce labour demand of foreign workers because after expiration of the employment contract and the employers could no longer hire foreign workers, they need to hire new labours, particularly foreign caretaker, leading to higher cost and time consuming to adjust themselves. Hence, the amendment of the law will not cause adverse affect to local labour’s operation.

Meanwhile, 6 Taiwan Industrial and Trade Entrepreneurship Associations called for government and the congress to amend the act in order to extend the duration of foreign workers’ stay to 12 years for those who work as caretaker and work in manufacturing sector for the sake of sustainably industrial development of Taiwan.
This official statement, signed by China Industrial Association, National Trade Association, Trade and Industrial Promotion Association, Industrial Promotion Association, Small and Medium Enterprise Promotion Association, indicates that it takes time to train imported alien workers to be proficient but after they return to their home country, the employers need to hire new foreign workers and start training them again resulting in high cost of training and adverse impact on production line.
On the contrary, extended stay for foreign workers could help reduce cost of training and adverse impact on production line resulting from labour shortage, cost of recruitment service as well as a number of runaway foreign workers because foreign workers could not apply for changing nationality or permanent adobe. Therefore, extended stay duration of foreign workers does not involve with problem of migration. The statement exemplifies the countries that not limit the duration of foreign workers’ stay such as South Korea, Hong Kong, and Singapore.

Taiwan labour federation and Democratic Progressive Party jointly arranged public statement on 4 January 2010 to oppose a proposal to extend the maximum contract for foreign workers from 9 years to 12 years. They said that in fact, local government’s care system for patient and disabled person can be applied. In addition, the government must review the policy on importation of foreign workers whether it is appropriate and whether they get protection on human rights or not. Also, the government should set up new system to aid the family of local labours who are unable to hire foreign workers and protect their human rights. Furthermore, Taiwan has only 150,000 elder disabled persons but the number of foreign caretakers is higher. These are problems that the government shall seek for a resolution, they said lastly.
However, the congress’s meeting on 4 January 2010 between the government and opposition party regarding the amendment of the act has not reached a resolution. Therefore, the issue of extending duration of foreign workers’ stay shall be reconsidered in the next meeting around February 2011
