นายสุชาติ ชมกลิ่น รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า ปัจจุบันมีนักท่องเที่ยวเดินทางเข้ามาในประเทศไทยเป็นจำนวนมาก โดยเฉพาะนักท่องเที่ยวจากสาธารณรัฐประชาชนจีน ที่ส่วนใหญ่เดินทางมาในรูปแบบของกรุ๊ปทัวร์ หรือผ่านบริษัทนำเที่ยว ทำให้มีผู้ประกอบธุรกิจนำเที่ยวจำนวนหนึ่งใช้บริการ ไกด์ หรือมัคคุเทศก์ ชาวต่างชาติที่ลักลอบประกอบอาชีพมัคคุเทศก์ในประเทศไทย ซึ่งมีความผิดตามกฎหมาย เพราะอาชีพมัคคุเทศก์หรืองานจัดนำเที่ยว เป็นงานที่กฎหมายกำหนดให้ผู้ประกอบวิชาชีพต้องมีสัญชาติไทยเท่านั้น และเป็นงานที่ห้ามคนต่างด้าวทำโดยเด็ดขาด ซึ่งระบุไว้ในบัญชีท้ายประกาศกระทรวงแรงงาน เรื่อง กำหนดงานที่ห้ามคนต่างด้าวทำ
นายสุชาติ กล่าวว่า รัฐบาลภายใต้การนำของ พล.อ. ประยุทธ์ จันทร์โอชา นายกรัฐมนตรี มีนโยบายส่งเสริมการท่องเที่ยว เพื่อนำเงินตราเข้าประเทศ เร่งฟื้นฟูเศรษฐกิจหลังสถานการณ์การแพร่ระบาดของโรคโควิดคลี่คลาย ซึ่งหากผู้ประกอบธุรกิจนำเที่ยวเลือกจ้างไกด์ต่างชาติแทนคนไทย นอกจากมีความผิดตามกฎหมายแล้วยังทำให้เกิดการแย่งอาชีพคนไทย ซึ่งกระทบต่อระบบเศรษฐกิจของประเทศ เพราะรายได้หลักทางหนึ่งของไทยมาจากอุตสาหกรรมการท่องเที่ยว ทั้งธุรกิจที่เกี่ยวข้องโดยตรงและธุรกิจที่เกี่ยวข้องทางอ้อม
ขณะที่นายไพโรจน์ โชติกเสถียร อธิบดีกรมการจัดหางาน กล่าวว่า กรมการจัดหางานบูรณาการร่วมกับหน่วยงานที่เกี่ยวข้องตรวจสอบการทำงานของคนต่างด้าว นายจ้าง สถานประกอบการ อย่างเคร่งครัด โดยเฉพาะกลุ่มคนต่างด้าวที่เข้ามาแย่งอาชีพของคนไทย เพื่อเป็นการควบคุม ตรวจสอบและดำเนินคดีคนต่างด้าวที่ลักลอบทำงานโดยผิดกฎหมาย พร้อมประชาสัมพันธ์สร้างการรับรู้ให้นายจ้าง สถานประกอบการ และคนต่างด้าวที่เข้ามาทำงานในประเทศไทยปฏิบัติตามกฎหมายอย่างถูกต้อง โดยผู้ที่พบเห็นการจ้างคนต่างชาติทำงานโดยผิดกฎหมาย สามารถแจ้งเบาะแสหรือร้องทุกข์ได้ที่ กองทะเบียนจัดหางานกลางและคุ้มครองคนหางาน กรมการจัดหางาน โทร. 02 354 1729 หรือ สำนักงานจัดหางานจังหวัดทุกจังหวัด สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1-10 หรือ ที่สายด่วนกระทรวงแรงงาน โทร.1506 กด 2 กรมการจัดหางาน
สำหรับงานที่ห้ามคนต่างด้าวทำมีทั้งสิ้น 40 งาน โดยงานมัคคุเทศก์ หรืองานจัดนำเที่ยว เป็นงานที่กฎหมายกำหนดไว้ในบัญชีที่ 1 ห้ามคนต่างด้าวทำเด็ดขาดในจำนวน 27 งาน เพราะเป็นอาชีพสงวนของไทย คนต่างด้าวจึงไม่สามารถขอใบอนุญาตทำงานต่อนายทะเบียนเพื่อทำงานดังกล่าวได้ รวมทั้งหากได้รับใบอนุญาตทำงานแล้วแต่ภายหลังลักลอบทำงานมัคคุเทศก์ จะมีความผิดตามพรก.การบริหารจัดการการทำงานของคนต่างด้าว พ.ศ. 2560 และที่แก้ไขเพิ่มเติม ปรับตั้งแต่ 5,000 –50,000 บาท และถูกส่งกลับประเทศ และในส่วนนายจ้าง/สถานประกอบการที่รับคนต่างด้าวทำงานโดยที่คนต่างด้าวไม่มีใบอนุญาตทำงาน หรือให้คนต่างด้าวทำงานนอกเหนือจากที่มีสิทธิจะทำได้ จะมีความผิดเช่นเดียวกัน ปรับตั้งแต่ 10,000-100,000 บาทต่อคนต่างด้าวที่จ้างหนึ่งคน หากกระทำผิดซ้ำมีโทษจำคุกไม่เกิน 1 ปี หรือปรับตั้งแต่ 50,000–200,000 บาทต่อคนต่างด้าวที่จ้างหนึ่งคน หรือทั้งจำทั้งปรับ และห้ามจ้างคนต่างด้าวทำงานเป็นระยะเวลา 3 ปี โดยปีงบประมาณ พ.ศ. 2566 มีการตรวจสอบนายจ้าง/สถานประกอบการแล้ว จำนวน 10,174 แห่ง ดำเนินคดี 360 แห่ง และตรวจสอบคนต่างชาติ จำนวน 156,471 คน ดำเนินคดี 808 คน ในจำนวนนี้เป็นคนต่างชาติที่แย่งอาชีพคนไทย จำนวน 435 คน
The Labour Minister, Mr. Suchart Chomklin, reported that many tourists are traveling to Thailand, especially tourists from China. They mostly travel in group tours or through a travel agency, which has caused several tour operators to use the service of guides and foreigners who illegally work as tourist guides in Thailand. Tourist guides or organizing tours is a profession reserved for Thai nationals only, according to the law. It is a job strictly forbidden from foreigners, specified in the list annexed to the Ministry of Labour’s notification on occupations prohibited by foreigners.
Mr. Suchart said that the government, under Prime Minister General Prayuth Chan-ocha, has a policy to promote tourism to bring in money to the country and accelerate the economy’s recovery after the COVID-19 pandemic has subsided. If a tour operator chooses to hire foreign guides instead of Thai people, in addition to having an offense under the law, it also impacts Thai people’s professions which affects the country’s economy. Tourism is one of Thailand’s main income sources, both from directly and indirectly related businesses.
The Department of Employment’s Director-General, Mr. Phairoj Chotikasatien, said that the Department of Employment has worked with relevant agencies to inspect the work of foreigners, employers, and establishments, especially foreigners occupying professions reserved for Thai people, to monitor, investigate and prosecute foreigners working illegally. It has also spread awareness for employers, establishments, and foreigners working in Thailand to comply with the law properly. Those who see illegal foreign workers can file a report to the Central Employment Registration and Job Seeker Protection Division, Department of Employment, call 02 354 1729, or contact the Provincial Employment Office, the Bangkok Employment Office Area 1-10, or at the Ministry of Labour’s hotline, call 1506 press 2, for the Department of Employment.
There are 40 jobs on the list of professions prohibited from foreign workers. Tour guides or tour operators are listed on List 1, which strictly prohibits foreigners from occupying, from a total of 27. It is a reserved occupation in Thailand. Therefore, foreigners cannot apply for a work permit from the Registrar to do such work. Those who have received a work permit but later illegally work as a guide will be guilty according to the Foreign Workers Management Act B.E. 2560 and its amendments. Foreigners working without work permits or outside their rights will be fined 5,000 – 50,000 Baht and deported. Employers who hire foreigners who do not have a work permit or allow foreigners to work outside their rights will be subject to fines ranging from 10,000-100,000 Baht per foreigner employed. Repeated offenses are punishable by imprisonment for not more than one year, a fine ranging from 50,000 to 200,000 Baht, or both. Employers in wrongdoing will be banned from employing foreigners for three years. In the 2023 fiscal year, 10,174 employers/establishments have been inspected, and 360 prosecuted. 156,471 foreigners have been examined, and 808 prosecuted, including 435 foreigners occupying professions reserved for Thais.
