วันที่ 15 มีนาคม 2567 นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน เป็นประธานการประชุมคณะกรรมการนโยบายการบริหารจัดการการทำงานของคนต่างด้าว (คบต.) ครั้งที่ 1/2567 โดยมีนายไพโรจน์ โชติกเสถียร ปลัดกระทรวงแรงงาน รองประธานกรรมการฯ นายสมชาย มรกตศรีวรรณ อธิบดีกรมการจัดหางาน เลขานุการฯ พร้อมด้วยคณะกรรมการจากหน่วยงานที่เกี่ยวข้องร่วมประชุม
นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน เปิดเผยว่า ช่วงเดือนเมษายน – พฤษภาคมของทุกปี แรงงานไทยและแรงงานประเทศเพื่อนบ้านจะเดินทางกลับภูมิลำเนาเพื่อร่วมประเพณีสงกรานต์ หรือเฉลิมฉลองปีใหม่ร่วมกับครอบครัว ดังนั้นเพื่ออำนวยความสะดวก และลดภาระค่าใช้จ่ายให้กับแรงงานซึ่งส่วนใหญ่เป็นกลุ่มคนที่มีรายได้น้อย รวมทั้งเพื่อสร้างภาพลักษณ์ที่ดีด้านแรงงานของประเทศไทยในระดับสากล ที่ประชุมคณะกรรมการนโยบายการบริหารจัดการการทำงานของคนต่างด้าว (คบต.) ครั้งที่ 1/2567 จึงได้ร่วมกันพิจารณาผ่อนผันให้แรงงานต่างด้าวสัญชาติกัมพูชา ลาว เมียนมา เดินทางกลับประเทศเพื่อร่วมงานประเพณีสงกรานต์ประจำปี 2567 ระหว่างวันที่ 1 เมษายน – 15 พฤษภาคม 2567 โดยยกเว้นค่าธรรมเนียมในการเข้า-ออก ซึ่งผู้ได้รับการผ่อนผันจะต้องเป็นแรงงานสัญชาติกัมพูชา ลาว เมียนมา ที่ถือหนังสือเดินทาง หรือเอกสารใช้แทนหนังสือเดินทาง ที่ได้รับการตรวจลงตรา (VISA) ประเภทคนอยู่ชั่วคราว (Non L-A Visa) รวมถึงผู้ติดตามซึ่งเป็นบุตรของแรงงานต่างด้าวดังกล่าวที่อายุไม่เกิน 18 ปี และระยะเวลาการอนุญาตให้อยู่ในราชอาณาจักร ต้องมีอายุเหลืออยู่ไม่น้อยกว่าวันที่ 15 พฤษภาคม 2567
“เพื่อเป็นขวัญกำลังใจในการทำงาน ให้พี่น้องแรงงานประเทศเพื่อนบ้านที่มาทำงานในบ้านเรา จึงผ่อนผันให้แรงงานเดินทางกลับประเทศต้นทางโดยไม่เก็บค่าธรรมเนียมใดๆ และขอให้ทุกคน เดินทางเข้า – ออกประเทศไทยตามช่องทางที่กฎหมายกำหนด” รมว.พิพัฒน์ กล่าว
ด้านนายสมชาย มรกตศรีวรรณ อธิบดีกรมการจัดหางาน กล่าวว่า สำหรับผู้ที่เดินทางในช่วงระยะเวลาผ่อนผันเจ้าหน้าที่จะประทับตราอนุญาตให้เดินทางออก – เข้าราชอาณาจักรในหนังสือเดินทาง เอกสารใช้แทนหนังสือเดินทาง โดยไม่ต้องยื่นคำขออนุญาตเพื่อกลับเข้ามาในราชอาณาจักรอีก (Re-Entry Permit) แต่หากประสงค์จะเดินทางกลับเข้าประเทศไทยหลังจากวันที่ 15 พฤษภาคม 2567 หรือยังไม่ทราบกำหนดการเดินทางกลับเข้าประเทศไทยที่แน่ชัด จะต้องยื่นคำขอ Re-Entry ตามปกติ มิฉะนั้นการอนุญาตให้อยู่ในราชอาณาจักรของคนต่างด้าวผู้นั้นเป็นอันสิ้นสุด ซึ่งจากนี้กรมการจัดหางานจะเสนอต่อคณะรัฐมนตรีเพื่อขอความเห็นชอบ ในระหว่างนี้กระทรวงมหาดไทย สำนักงานตรวจคนเข้าเมือง จะเร่งยกร่างกฎกระทรวงและประกาศกระทรวงมหาดไทย ให้แล้วเสร็จและแจ้งแนวทางให้นายจ้าง สถานประกอบการ และแรงงาน 3 สัญชาติทราบต่อไป
ทั้งนี้ ระยะเวลาการผ่อนผันดังกล่าวจะเป็นไปตามที่ประกาศกระทรวงมหาดไทยกำหนด ขอให้ติดตามข่าวสารจากกรมการจัดหางานอย่างใกล้ชิด ที่เว็บไซต์กรมการจัดหางาน doe.go.th หรือสอบถามข้อมูลเพิ่มเติมได้ที่ สำนักงานจัดหางานกรุงเทพมหานครพื้นที่ 1 – 10 หรือสำนักงานจัดหางานจังหวัดทั่วประเทศ หรือที่สายด่วนกระทรวงแรงงาน โทร. 1506 กด 2 กรมการจัดหางาน และสายด่วนกรมการจัดหางาน โทร. 1694
On March 15, 2024, the Labour Minister, Mr. Phiphat Ratchakitprakarn, chaired the Foreign Worker Management Policy Committee Meeting No. 1/2024. The Permanent Secretary of Labour, Mr. Phairoj Chotikasathien, the Department of Employment’s Director-General, Mr. Somchai Morakotsriwan, and committee members from related agencies attended the meeting.
The Labour Minister, Mr. Phiphat Ratchakitprakarn, said that from April to May of every year, Thai workers and workers from neighbouring countries would return to their hometowns to participate in the Songkran tradition or celebrate the New Year together with their families. Therefore, to facilitate and reduce the cost burden on workers, most of whom are low-income workers, and to create a good image of Thailand’s workforce at the international level, the Foreign Worker Management Policy Committee Meeting No. 1/2024 considered granting permission to foreign workers of Cambodian, Laos, and Myanmar nationality to return to their countries to participate in the 2024 Songkran tradition between April 1 to May 15, 2024, with entry and exit fees waived. The person receiving the waiver must be a worker of Cambodian, Laos, and Myanmar nationality who holds a passport or a document used in place of a passport who has received a visa, the temporary stay type (Non-L-A Visa), including dependents who are children of such foreign workers who below 18 years of age and the period of permission to stay in the Kingdom must expire after May 15, 2024.
“To provide morale in working, we will support workers from neighboring countries who are working in our country to return to their countries of origin without collecting any fees. We ask that everyone who travels in and out of Thailand do so according to the channels specified by law,” said Minister Phiphat.
The Department of Employment’s Director-General, Mr. Somchai Morakotsriwan, said that for those traveling during the grace period, officials will stamp permission to leave and enter the Kingdom in their passports, including documents used in lieu of a passport. There will be no need to apply for permission to re-enter the Kingdom (Re-Entry Permit). However, if workers wish to return to Thailand after May 15, 2024, or do not yet know their exact return dates to Thailand, Re-Entry applications must be submitted as usual. Otherwise, the worker’s permission to stay in the Kingdom will be terminated. From here, the Department of Employment will present it to the Cabinet for approval. In the meantime, the Ministry of Interior’s Immigration Office will expedite the drafting of ministerial regulations and announcements from the Ministry of Interior and inform employers of the guidelines, including workers of the three nationalities.
The said grace period will be as specified in the announcement of the Ministry of Interior.
