วันที่ 22 เมษายน 2567 นายพิพัฒน์ รัชกิจประการ รัฐมนตรีว่าการกระทรวงแรงงาน กล่าวถึงของขวัญสำหรับผู้ใช้แรงงาน ในวันแรงงาน 1 พ.ค.2567 นี้ว่า จะมีบิ๊กเซอร์ไพรส์แน่นอน โดยของขวัญชิ้นสำคัญคือ จะมีรายละเอียดเรื่องค่าแรงขั้นต่ำทั่วประเทศ 400 บาท โดยผ่านคณะกรรมการไตรภาคี ซึ่งจะดำเนินการเร็วขึ้นจากแผนงานที่วางเอาไว้
นายพิพัฒน์ ได้กล่าวอีกว่า ในส่วนของขวัญชิ้นต่อมา คือ ขยายเวลา วงเงินกู้สำหรับแรงงานอิสระทำงานจากที่บ้าน ที่ขณะนี้มีผู้กู้ไปแล้วกว่า 1 ล้านบาท ซึ่งจะหมดอายุในวันที่ 30 เมษายนนี้ จึงได้หารือกับอธิบดีกรมการจัดหางาน ว่าหากวันที่ 30 เมษายน วงเงินยังใช้ไม่หมด ขอให้ขยายเวลาออกไปให้วงเงินกู้สามารถใช้ได้จนหมด เพราะเป็นประโยชน์ ซึ่งใน 2 ปีแรกไม่มีดอกเบี้ย ส่วนปีที่ 3 คิดดอกเบี้ย 2%
นายพิพัฒน์ กล่าวว่า ของขวัญชิ้นต่อมาคือ การผลักดันอนุสัญญาฉบับที่ 87 ว่าด้วยเสรีภาพในการสมาคมและการคุ้มครองสิทธิในการรวมตัว ค.ศ. 1948 และอนุสัญญาฉบับที่ 98 ว่าด้วยการปฏิบัติตามหลักการแห่งสิทธิในการรวมตัวกันและสิทธิในการร่วมเจรจาต่อรอง ค.ศ.1949 ผ่านขั้นตอนที่ 1 จากทั้งหมด 7 ขั้นตอน อยู่ในช่วงกลั่นกรองข้อกฎหมายโดยคณะกรรมการไตรภาคี โดยตั้งเป้าในช่วงมิถุนายน – กันยายน จะนำเข้าครม.และเข้าสู่กฤษฎีกา หลังจากนั้นจะนำเข้าสภาผู้แทนราษฎร และวุฒิสภา ด้วยเงื่อนไขของกระบวนการทางกฎหมาย
รมว.แรงงาน กล่าวว่า ขณะนี้ผู้ใช้แรงงานได้ช่วยกันผลักดัน โดยหลักใหญ่ฝ่ายนายจ้างก็จะไม่ค่อยเห็นด้วยในฉบับที่ 87 ถ้าฉบับที่ 98 ฝ่ายนายจ้างค่อนข้างจะเห็นด้วย แต่ฝ่ายข้าราชการมีทั้งเห็นด้วย งดออกเสียง ทั้งสองฉบับ เพราะฉะนั้นต้องดูว่าสุดท้ายแล้วทางลูกจ้าง นายจ้าง และข้าราชการจะเลือกให้ผ่านทั้งสองฉบับ หรือฉบับเดียว ทั้งนี้กระทรวงแรงงานมุ่งมั่นที่จะประกาศใช้ทั้ง 2 ฉบับ ซึ่งผู้ใช้แรงงานสามารถมีส่วนร่วมในการผลักดันให้กฎหมายเกิดขึ้นจริง โดยทำความเข้าใจข้อดีและข้อเสียของทั้ง 2 ฉบับ
“ผมดีใจที่เราสามารถผ่านมติขั้นที่ 1 ทั้งฉบับที่ 87 และ 98 ซึ่งตลอดระยะเวลา 30 ปี ไม่เคยผ่านขั้นตอนแรก เพราะฉะนั้นตัวผมเองพยายามจะให้ผ่านทุกขั้นตอนภายในรัฐบาลชุดนี้ แต่ทั้งหมดอยู่ที่คณะกรรมการไตรภาคี ว่าเห็นด้วยทั้งสองฉบับ หรือเห็นด้วยฉบับใดฉบับหนึ่ง แต่ถือเป็นจุดเริ่มต้นที่ดี สำหรับตัวผมเห็นด้วยทั้ง 2 ฉบับ” นายพิพัฒน์ กล่าว
นายพิพัฒน์ กล่าวอีกว่า ของขวัญชิ้นต่อมาก็คือ การผลักดันอนุสัญญาฉบับที่ 144 ว่าด้วยการปรึกษาหารือไตรภาคี (มาตรฐานแรงงานระหว่างประเทศ) ค.ศ.1976 และอนุสัญญาฉบับที่ 155 ว่าด้วยความปลอดภัยและสุขภาพอนามัยในการทำงาน ค.ศ.1981 ให้แล้วเสร็จก่อนที่จะไปประชุม ILO ในวันที่ 11 -15 มิถุนายน ที่กรุงเจนีวา โดยมั่นใจว่า อนุสัญญาฉบับที่ 144 จะเสร็จทัน แต่ฉบับที่ 155 จะพยายามทำให้ทัน ตั้งเป้าจะประกาศรับรองอย่างเป็นทางการในที่ประชุมที่กรุงเจนีวา
นอกจากนี้แต่ละหน่วยงานจะนำเสนอของขวัญให้กับผู้ใช้แรงงาน เพิ่มเติมอีกด้วย
On April 22, 2024, the Labour Minister, Mr. Phiphat Ratchakitprakarn, spoke about the gifts for the workforce for Labour Day, May 1, 2024. He said that it would definitely be a big surprise. The key gift is that further details will be provided on the nationwide minimum wage of 400 Baht, formed through a tripartite committee, which will be carried out faster than planned.
Mr. Phiphat continued that the next gift is an extension of the loan amount for independent workers working from home. Currently, over 1 million Baht has been loaned to borrowers, which will expire on April 30. Therefore, he discussed with the Department of Employment’s Director-General that if on April 30 the credit limit has not yet been used up, it will request an extension of time so that the loan amount can be used up completely, as the loan is beneficial. In the first two years, there is no interest, and in the third year, interest is charged at 2 percent.
Mr. Phiphat said that the next gift is promoting Convention No. 87 on Freedom of Association and the Protection of the Right to Organize 1948 and Convention No. 98 on the Implementation of the Principles of the Right to Organize and the Right to Collective Dialogue Negotiation, 1949. The process has passed the first step out of a total of seven steps. Currently, the tripartite committee is in the process of scrutinizing the law. The target is to bring the proposal to the Cabinet from June to September and then enter into a decree. After that, it will be brought to the House of Representatives and the Senate under the conditions of the legal process.
The Labour Minister said that currently, workers are helping to push forward the conventions. It is mainly employers that will not agree with Convention No. 87. For Convention No. 98, employers are likely to agree. On the civil servant’s side, some parties agree and abstain from voting on both versions. Therefore, it must be seen that, in the end, the employees, employers, and civil servants will choose to pass both versions or just one. The Ministry of Labour is committed to promulgating both versions, in which workers can participate in pushing for the laws to become a reality by understanding the advantages and disadvantages of both.
“I am glad that we were able to pass the first stage of resolutions for Conventions No. 87 and No. 98. In 30 years, these have never passed the first stage. Therefore, I am trying to push through every stage within this government. But it all lies with the tripartite committee to agree with both conventions or any one convention. However, it is considered a good starting point. For myself, I agree with both conventions,” Mr. Phiphat said.
Mr. Phiphat said that the next gift is promoting Convention No. 144 on Trilateral Consultation (International Labour Standards), 1976, and Convention No. 155 on Occupational Health and Safety, 1981, to be completed before going to the ILO meeting on June 11 to 15, in Geneva. He is confident that Convention No. 144 will be completed in time, but for No. 155, they will aim to complete it in time, with the goal of officially announcing its approval at the meeting in Geneva.
In addition, each agency will present more gifts to workers.
